Announcement: Trustee Candidate Martin Withdraws from 2018 Municipal Election

The Town of Nederland would like to inform its residents that Hillary Martin has officially withdrawn from the 2018 Municipal Elections as a Board of Trustees candidate, as of March 13, 2018.

With a Board of Trustees seat remaining vacant, the process to appoint a new member to that position under the Title 10 of Title 31 of the Colorado Revised Statutes, as follows:

Vacancies in Nomination:  As described in CRS 31-10-304, if a vacancy becomes available prior to twenty-three days before the day of the election, the vacancy may be filled by a vacancy committee (designated on the candidates original nomination petition) or by write-in candidate affidavit, if before write-in deadline as stated in CRS 31-10-912. Unfortunately, there was no designated candidate committee assigned by Candidate Martin on her nomination petition, submitted January 22nd, 2018.

Write-in Candidates Affidavit: According to CRS 31-10-306, the State of Colorado requires that all write-in candidate affidavits must be filed no later than 64 days before the election (January 29th,2018).

Write-in Candidate Affidavit in Mail Ballot Election: Stated in CRS 31-10-912, No write-in votes for any office shall be counted unless an affidavit of intent to be a write-in candidate has been filed with the clerk by person wishing to be a write-in candidate not later than 64 days before the day of the election.

There were no write-in candidate affidavits submitted to the Town Clerk prior to January 29th, 2018.

At this time, the candidate vacancy will remain open until the election is final. Once the new Trustees and Mayor are sworn in, the open Trustee seat is considered officially vacant. The Board of Trustees will then appoint a Trustee to fill the open seat for a two year term, instead of the four-year term expected of all elected candidates. At the end of the two-year term, coinciding with the next Municipal election, the appointed Trustee will be required to submit a Municipal Election Nomination Petition and be voted onto the Board of Trustees for the following two-year term.
